The tenant of unit #202 has been in a constant state of remodeling for nearly 7 years. She begins a project, tears it out, and starts again. There has been no respite from the constant hammering, drilling, pounding, sawing and other nuisances that are a result of this obsessive behavior. The HOA has asked her to provide plans, a timeline of completion and to work within more acceptable hours to reduce the stress from the ceaseless construction. She has refused to follow any guidelines and has shown complete and total disrespect for all tenants in the building (another set of tenants moved out in part because of her behavior).
Problems caused by the never-ending construction could amount to endangering tenants in the building. She has not brought in licensed contractors for the majority of her work and has severed through electrical and communications wiring on a few occasions. She admitted to rerouting her plumbing herself, which could cause further damage to unit #102 and the building in general.
Finally, the asking price is above current market value for a similar new loft in the area. The total amount of the unpaid balance of the obligation secured by the property to be sold and reasonable estimated costs, expenses and advances at the time of the initial publication of the Notice of Sale is $425,700.12 .
